CvCy Talent General Terms of Use

1. Purpose

CvCy Talent is an online platform for job seekers. It lets you create and tailor a resume, generate cover letters, search for job offers, track your applications, practice for interviews, and publish a professional portfolio.

These Terms govern the contractual relationship between CvCy Talent and any individual (the "User") who creates an account and uses the service.

2. Service provider

CvCy Talent is published by Y Studio, a company based in Dakar, Senegal.

The platform's infrastructure is hosted within the European Union by Supabase (data) and Vercel (application), both GDPR compliant.

3. Access to the service

The service includes a free plan, accessible without payment but with limited usage, and a paid plan unlocking every feature without limits. Access opens upon account creation.

Access credentials are personal, non-transferable, and must be kept strictly confidential. The User is responsible for all actions taken from their account.

The paid plan is billed weekly, monthly, or quarterly depending on the option chosen by the User, and is never automatically renewed beyond the subscribed period.

4. Prohibited uses

It is strictly forbidden to:

  • Create a resume, cover letter, or portfolio containing knowingly false information intended to mislead a recruiter
  • Use the platform to impersonate another person
  • Resell, sublicense, or make the service available to third parties without CvCy Talent's written consent
  • Attempt to access, reverse-engineer, or copy the platform's source code or algorithms
  • Use automated scripts or bots to extract data from the platform without CvCy Talent's authorization
  • Use the service for any unlawful activity or activity contrary to applicable law

5. Intellectual property

CvCy Talent and all its components (source code, algorithms, interface, brand, logo, documentation, resume templates) are the exclusive property of Y Studio and are protected by applicable intellectual property laws.

The User is granted a personal, non-exclusive, non-transferable license to use the platform, strictly within the scope of these Terms.

The User retains ownership of all data and content they create on the platform (resume, cover letters, portfolio, interview simulation answers). CvCy Talent claims no rights over this content.

CvCy Talent may use anonymized and aggregated data to improve its algorithms and services, provided this data cannot identify any individual.

6. Personal data protection

CvCy Talent processes the User's personal data as data controller, in accordance with the GDPR and Senegalese Law No. 2008-12 on the protection of personal data.

6.1 Nature of data processed

CvCy Talent processes the following categories of personal data:

  • Identification data: first name, last name, email address, phone number
  • Professional data provided by the User: resume, cover letters, experience, education, skills, portfolio
  • Usage data: offers viewed, tracked applications, interview simulation answers and related AI feedback
  • Account data: login credentials, language preferences, subscription history

CvCy Talent does not process sensitive data (Article 9 GDPR) and encourages Users not to include any in their resume or cover letter unless they explicitly and voluntarily choose to.

6.2 Purposes of processing

  • Providing the service: resume creation and tailoring, cover letter generation, job search, application tracking, interview simulation, portfolio
  • AI-based improvement and tailoring of content, based on information provided by the User
  • Account and subscription management
  • Service-related communication (account confirmation, notifications, support)

6.3 Data retention periods

  • Active account: data is retained for as long as the account exists.
  • After account deletion: data is retained for 30 days to allow the User to reconsider, then permanently deleted, unless otherwise required by law.
  • Billing data: retained for 10 years in accordance with accounting obligations, for paid-plan users only.

6.4 Security measures

CvCy Talent implements the following technical and organizational measures:

  • Encryption of data at rest (AES-256) and in transit (TLS 1.2+)
  • Role-based access control and least-privilege principle
  • Automatic daily backups with 30-day retention
  • Monitoring and alerts for abnormal activity
  • Infrastructure hosted with ISO 27001 / SOC 2 certified providers

6.5 Sub-processors

CvCy Talent uses the following approved sub-processors:

  • Supabase: database hosting, EU (Ireland)
  • Vercel: application hosting, EU
  • AI model providers: content generation and tailoring (resumes, letters, interview questions), governed by a GDPR-compliant data processing agreement

6.6 User rights

The User has the following rights under the GDPR: right of access, rectification, erasure, restriction of processing, portability, and objection.

These rights are exercised directly with CvCy Talent at contact@cvcy.app, within one month, extendable to three months depending on the complexity of the request.

6.7 Data breach notification

In the event of a personal data breach likely to result in a risk to Users, CvCy Talent will notify the individuals concerned and, where applicable, the competent supervisory authority, without undue delay and in accordance with Article 33 of the GDPR.

7. International data transfers

Although data is hosted within the European Union, since CvCy Talent is established in Senegal, access to data by its teams may constitute an international transfer under the GDPR.

These transfers are governed by the Standard Contractual Clauses (SCC) adopted by the European Commission (Decision 2021/914 of 4 June 2021). Senegalese data protection law (Law No. 2008-12) provides an adequate level of protection for transfers of data from the EU.

Transfers to AI model providers located outside the EU are governed by their standard contractual safeguards and a GDPR-compliant data processing agreement.

8. AI-generated content

The AI improvement and tailoring features rephrase the content provided by the User, but never invent numbers, companies, or experience that were not provided.

The User remains solely responsible for the accuracy of the information on their resume, cover letter, and portfolio, including content rephrased or suggested by the AI, before sending it to a recruiter.

9. Service availability

CvCy Talent strives to maintain high service availability, without guaranteeing absolute continuity.

Planned maintenance operations may cause brief interruptions, preferably carried out outside peak usage hours.

In the event of unplanned downtime, CvCy Talent strives to restore service as quickly as possible.

10. Termination

10.1 Termination by the User

The User may delete their account or cancel their paid subscription at any time from their personal space. Cancelling a paid subscription takes effect at the end of the current period; no refund is granted for the period already underway.

10.2 Termination by CvCy Talent

CvCy Talent may suspend or terminate a User's account in the event of a serious breach of these Terms (prohibited use, fraud, non-payment), following notice whenever possible.

10.3 Effects of termination

Upon account deletion, the User has 30 days to export their documents (resume, letters). After that period, all data is permanently deleted from CvCy Talent's systems.

11. Liability

CvCy Talent commits to providing the service with diligence, as a best-efforts obligation.

CvCy Talent's total and cumulative liability, regardless of cause, is limited to the amounts actually paid by the User during the twelve (12) months preceding the event giving rise to the damage.

CvCy Talent cannot be held liable for:

  • Hiring decisions made by third parties (recruiters, companies) based on documents produced by the User
  • Indirect, incidental, or consequential damages (loss of income, loss of career opportunity)
  • Data loss caused by improper use of the service or a breach of these Terms
  • Service interruptions attributable to the User's internet connectivity or third-party systems
  • Damages resulting from force majeure events

12. Changes to the Terms

CvCy Talent reserves the right to modify these Terms at any time. Users will be informed by email at least 30 days before any substantial change takes effect. Continued use of the service after this period constitutes acceptance of the updated Terms.

13. Governing law and jurisdiction

These Terms are governed by Senegalese law, in accordance with Law No. 2008-12 on the protection of personal data and the regulations of the Data Protection Commission (CDP).

For Users residing in the European Union, the GDPR applies as the primary data protection framework.

Failing an amicable resolution, disputes will be submitted to the competent courts of Dakar, Senegal, unless otherwise required by mandatory consumer-protection law.
